- Your booking
1.1. A booking agreement is made when a traveler books or reserves a place on a tour of Photo Tour Specialist. This is only possible via the booking form on the website of Photo Tour Specialist. The day we receive a travelers personal data (name, address, place of residence and date of birth) is the date of the agreement. The traveler receives a digital confirmation of the travel agreement and payment information.
1.2. The tours listed in our publications are non-committal offers. Photo Tour Specialist reserves the right to reject your booking agreement. If this is the case, you will be notified of this along with an explanation within 8 office hours.
1.3. Our tours are executed as specified in our publications. Deviation from the tour contents will always be communicated in writing.
1.4. A person who confirms a booking on behalf of another person, is personally liable for all obligations that come with the agreement.
1.5. Special requests will be taken into account whenever possible, but Photo Tour Specialist is not obligated to honor these requests even if noted on the booking agreement form. - Payment conditions
2.1. After receiving a booking confirmation, an advance payment of 20% of the tour costs plus booking costs must be made within 7 business days.
2.2. The remaining amount due must be paid no later than 56 days before departure. If a booking is made within 56 days before departure, the full amount must be paid within 7 business days.
2.3. Payments not received in time, after sufficient payment reminder, can lead to immediate cancellation of the booking by Photo Tour Specialist. In such cases, Photo Tour Specialist retains the right to charge the usual cancellation costs. - Tour costs
3.1. The tour costs specified in our publications are per person and include all services and accommodations as specified in the publication, unless noted otherwise.
3.2. The tour costs are based on prices, exchange rates, levies and taxes as they were known to Photo Tour Specialist at the moment of publication and can be subject to change.
3.3. While the tour costs are not paid in full, Photo Tour Specialist retains the right to change the tour costs to compensate for changing prices, exchange rates, levies and taxes. Travelers will always receive a written explanation if this is the case.
3.4. Travelers have the right to reject a price change as mentioned in previous article within 3 business days. Photo Tour Specialist can then either cancel the price change or cancel the booking agreement. In this case, the traveler will receive full restitution of all tour cost payments. - Tour duration
4.1. The tour duration in publications of Photo Tour Specialist is specified in whole days, where the day of departure and return are counted as whole days. - Tour information & travel documents
5.1. It is a travelers responsibility to carry the proper travel documents, such as flight tickets, driving license, greencard and passport.
5.2. Photo Tour Specialist is not liable if a traveler cannot participate in one of more aspects of the tour due to shortcomings in their travel documents.
5.3. Unless specified otherwise, tour information will be sent no later than 10 days before departure. If a traveler has not received the proper tour information in time, they must notify Photo Tour Specialist immediately. - Changing your booking details
6.1. After a booking agreement is confirmed, a traveler can request changes in the agreement up to 28 days to departure. If this request is not a (partial) cancellation and if this request is granted by the tour operator, the request will be honored and confirmed in writing.
6.2. Requests as specified in previous article can cause changes in tour costs or additional costs for the request itself. A traveler is obligated to pay these costs. - Transfer booking to another person
7.1. Before depature, a person can replace themselves by another on one of tours, if:
a. the other person agrees to all commitments and responsibilities associated with the booking agreement
b. the executing touroperators and service providers do not object to the booking transfer
c. all the required details for the booking transfer are received by Photo Tour Specialist no later than 7 days before departure
7.2. The person who made the booking and the person that the booking is transferred to, are both personally responsible for any due payments associated with the booking agreement, as well as potential additional costs for executing the booking transfer - Cancellation conditions
8.1. A cancellation of a booking agreement can only be accepted in writing via post or via e-mail. The date on the postage stamp or e-mail header is the official notification date.
8.2. If a booking agreement is cancelled, a traveler has to pay standard reservation costs, plus:
a. before 56 days to departure: 15% of the tour price
b. from 56 days to 42 days to departure: 30% of the tour price
c. from 42 days to 28 days to departure: 50% of the tour price
d. from 28 days to 14 days to departure: 75% of the tour price
e. form 14 days to 7 days to departure: 90% of the tour price
f. 7 days or less to departure: the full tour price
N.B.: Under special circumstances this risk can be covered by a cancellation insurance. - Amendments or cancellation by Photo Tour Specialist
9.1. Photo Tour Specialist retains the right to amend essential parts of the booking agreement in reasonable ways with sufficient grounds. Sufficient grounds meaning circumstances of a nature where Photo Tour Specialist can no longer reasonably be expected to commit to the agreement.
9.2. Traveler will be notified as soon as possible in case of amendments as mentioned in article 9.1.
9.3. In case of amendments as mention in article 9.1, traveler retrains the right to reject these amendments. In such cases a traveler is entitled to either a comparable tour offer, or restitution of the paid amount for the tour package or proportional part thereof in case of a partially enjoyed tour. If a traveler wants to make use of their rights for restitution, they must notify Photo Tour Specialist within 48 hours of receiving the notice of amendments.
9.4. Photo Tour Specialist is allowed to amend non-essential parts of the booking agreement with sufficient grounds. In such cases a traveler can only reject these amendments if the changes lead to more than small disadvantages. - Liability of Photo Tour Specialist
10.1. Photo Tour Specialist is responsible for a proper execution of all obligations stemming from this booking agreement.
10.2. Photo Tour Specialist and associated service providers are not responsible for damages or shortcomings in the execution of this agreement, if the damage or shortcoming:
a. are caused by the traveler
b. are the result of actions or influence by third parties who are not concerned parties in the execution of the booking agreement
c. are caused by Force Majeure, as defined in 10.3
10.3. Force Majeure includes all abnormal and unforeseen circumstances that are not controlled by the will of the parties of this agreement and could not have been avoided despite preventive measures
10.4. Photo Tour Specialist is not liable for any damanges covered by travel- or cancellation insurance, unless the damage can directly be attributed to actions of Photo Tour Specialist.
10.5. In cases where Photo Tour Specialist can be held responsible for loss of tour enjoyment or damages that are suffered by the traveler, the amount of compensation will not exceed the total tour package price. - Traveler obligations
11.1. A traveler is obligated to follow any instructions or advice from Photo Tour Specialist and their service providers before, during and after the execution of the tour. A traveler is liable for any damages or costs resulting from failing to comply with this obligation. - Complaints
12.1. Any complaints exceeding the level of remarks or feedback, are to be made as soon as possible, preferably in writing to the service providers executing the tour so the complaint can be resolved immediately. If the complaint is not resolved within reasonable time and clearly diminishes the quality of the tour, the traveler must contact Photo Tour Specialist immediately (any communication costs will be compensated where reasonable, if the complaint is found admissible).
12.2. If after contacting Photo Tour Specialist the complaint still cannot resolved to satisfaction, the traveler can file an official complaint in writing and sufficiently motivated with Photo Tour Specialist. The complaint has be received by Photo Tour Specialist no later than 30 days after the end of the tour.
If a complaint is not resolved within three months, or if the traveler does not agree with the offered resolution(s), the traveler can seek judicial assistance up to a year after the end of the tour.
12.3. This booking agreement and all liabilities and responsibilities stemming from it, are subject to Dutch law. - Errors in publications
Apparent mistakes or print errors in one or more of our publications are not binding for Photo Tour Specialist.
